Welcome to WitchesMarketplace.com (“the Site”).
By accessing, browsing, or using the Site, you agree to comply with and be bound by these Terms of Service (“Terms”), along with our Privacy Policy and Vendor Agreement (if applicable).

If you do not agree, do not use the Site. By continuing to use this Site you are agreeing to the terms.

1. Overview

WitchesMarketplace.com is an online multi-vendor marketplace where independent sellers (“Vendors”) offer handmade, witchcraft-related, metaphysical, spiritual, artistic, and alternative lifestyle products to customers (“Buyers”).
WitchesMarketplace.com (“we”, “us”, “our”) acts as a platform, not the seller of goods.

All items are sold by the Vendor listed on each product page.

2. Eligibility

To use the Site, you must:

• Be at least 18 years old.
• Have the legal capacity to enter into contracts.
• Agree not to use the Site for illegal, harmful, or fraudulent activity.

Vendors must also comply with:

• Local, federal, and international laws.
• Marketplace rules and listing policies.

3. Marketplace Role

WitchesMarketplace.com:

• Does not own or manufacture any Vendor products (except our own branded items).
• Does not guarantee product quality, legality, or accuracy beyond reasonable moderation.
• Facilitates payment processing, order management, and platform support.
• Is not responsible for disputes between Buyers and Vendors but may assist in mediation.

4. Accounts

You are responsible for:

• Providing accurate information
• Keeping your login secure
• All actions taken under your account

We may suspend or terminate accounts that violate our policies.

5. Vendor Listings & Content

Vendors are fully responsible for:

• Product descriptions
• Pricing
• Photography
• Shipping times
• Inventory accuracy
• Compliance with all laws (e.g., labeling, safety, ingredient listing, claims restrictions)

Prohibited content includes:

• Copyrighted content you do not own
• Explicit content
• Dangerous items
• False metaphysical/medical claims (“This cures disease”)

WitchesMarketplace.com may remove listings at our discretion.

6. Fees & Commissions

Vendor fees are determined by your tier (Founders, Circle of Fifteen, etc.).
Fees may include:

• Marketplace commission
• Payment processor fees
• Optional upgrades

We reserve the right to adjust commission structures with notice to Vendors (Founders’ lifetime rates remain locked).

7. Payments & Payouts

Payments are processed via Stripe or other approved processors.
Vendors agree to:

• Maintain an active Stripe account
• Pay applicable fees
• Comply with all Stripe policies

Payout timing is controlled by the payment processor, not WitchesMarketplace.com.

8. Shipping & Delivery

Vendors must:

• Ship orders within stated timeframes
• Provide tracking when applicable
• Maintain transparent shipping policies

Buyers understand shipping is handled directly by the Vendor.

9. Returns, Refunds & Disputes

Each Vendor sets their own return/refund policy.

If no policy is provided:

• The default is no returns unless the item is defective or incorrect.

Disputes:

• Buyer should contact the Vendor first
• WitchesMarketplace.com may step in, but final responsibility lies with the Vendor and Buyer

Chargebacks follow the payment processor (Stripe’s) rules.

10. Intellectual Property

You retain rights to your uploaded content.
By posting content on the platform, you grant WitchesMarketplace.com a non-exclusive, royalty-free license to display, promote, and distribute that content within the site.

We may remove infringing materials.

11. Prohibited Activities

Users may NOT:

• Sell illegal, dangerous, counterfeit, or stolen goods
• Harass or abuse others
• Attempt to harm the Site or payment systems
• Collect user data without permission
• Circumvent fees or platform rules

Violations may result in immediate account removal.

12. Limitation of Liability

To the extent permitted by law:

• WitchesMarketplace.com is not liable for lost profits, data, or damages
• Use of the Site is “as-is” and “as available”
• We cannot guarantee uninterrupted or error-free service

13. Termination

We may suspend or terminate accounts for:

• Policy violations
• Fraudulent activity
• Payment issues
• Harmful behavior

Users may close accounts at any time.

14. Changes to Terms

We may update these Terms as needed.
Continued use of the Site means you accept the updated Terms.
