Bone & Animal Remains Policy

Bone & Animal Remains Policy

(Vendor-Facing Policy – Required Compliance)

Purpose

WitchesMarketplace supports the ethical, lawful sale of animal bones and remains for curio, decorative, educational, and traditional ritual use. Due to federal, state, and international wildlife laws, the sale of bones and animal remains is strictly regulated.

This policy exists to protect the marketplace, vendors, and buyers while ensuring all listings comply with applicable laws.

1. General Rule

Vendors may sell animal bones or remains ONLY if:

  • The species is legal to possess and sell

  • The item was legally and ethically obtained

  • The sale complies with federal, state, and local laws

  • No prohibited claims are made regarding outcomes or effects

Ethical sourcing alone does not guarantee legality.

2. Prohibited Items (ZERO TOLERANCE)

The following items are strictly forbidden and may not be listed under any circumstances:

  • Native bird bones or parts (including feathers, wings, skulls, talons)

  • Birds of prey (hawks, owls, eagles, vultures, ravens, crows, etc.)

  • Eagle parts of any kind

  • Endangered or threatened species

  • Marine mammals (whales, dolphins, seals, sea lions)

  • Human remains (including fragments, teeth, ashes, or “medical curios”)

  • Any item obtained through poaching, illegal trade, or unverified sources

Listings containing prohibited items will be removed immediately, and vendor accounts may be suspended or permanently banned.

3. Generally Permitted Species (When Legally Sourced)

The following are commonly lawful to sell when obtained legally:

  • Cow / cattle

  • Deer (subject to state laws — see Section 4)

  • Goat

  • Sheep

  • Pig / boar

  • Buffalo / bison

  • Domesticated poultry (chicken, turkey, duck)

  • Fish bones from non-protected species

⚠️ Vendors are still responsible for verifying legality in their jurisdiction.

4. Roadkill & Wildlife Restrictions

Some states regulate:

  • Collection of roadkill

  • Possession of wildlife parts

  • Resale of wildlife remains

If bones originate from roadkill or wild animals, vendors must:

  • Follow state permit requirements (if applicable)

  • Ensure resale is legal in their state

  • Disclose lawful acquisition upon request

WitchesMarketplace does not verify permits on behalf of vendors.

5. Required Listing Disclosures

All bone or animal remains listings must include:

  • Species name (common or scientific)

  • Source of acquisition (farm, butcher, supplier, etc.)

  • Acknowledgment that the item is lawfully obtained

  • Proper disclaimers (see Section 6)

Failure to disclose species or source may result in listing removal.

6. Claims & Use Restrictions

Bones and animal remains may be sold for:

  • Curio use

  • Decorative use

  • Educational use

  • Traditional or ritual practices

Vendors may not:

  • Guarantee spiritual, magical, medical, legal, or physical outcomes

  • Claim healing, protection, luck, curses, or results

  • Present items as treatments or remedies

Required Disclaimer Language

Listings must include language substantially similar to:

“This item is sold as a curio or for educational or traditional use only. No claims are made regarding outcomes or effects.”

7. Vendor Responsibility & Liability

By listing bones or animal remains, vendors affirm that:

  • All items comply with applicable laws

  • All representations are truthful and accurate

  • They assume full legal responsibility for their listings

WitchesMarketplace is a platform provider and is not liable for vendor violations of wildlife or animal protection laws.

8. Enforcement

WitchesMarketplace reserves the right to:

  • Remove listings without notice

  • Request documentation or clarification

  • Suspend or terminate vendor accounts

  • Cooperate with legal authorities if required

Repeated or severe violations will result in permanent removal from the platform.

Final Word (Plain English)

If you don’t know the species
If you can’t explain where it came from
If it had wings in the U.S.
If it feels legally “iffy”

Don’t list it.

When in doubt, leave it out.
